How Long is a Trademark Valid in India?
A registered trademark in India is valid for 10 years from the date of filing the original application. It can be renewed indefinitely for successive 10-year periods by filing Form TM-R and paying the prescribed fee. There is no limit on the number of renewals — your brand can be protected in perpetuity as long as you renew on time.

Timely Renewal (Form TM-R)
The best time to file for renewal is within one year before your trademark's expiry date. Filing early does not shorten your protection — the renewed ten years still runs from the previous expiry date, not from the date you paid.
Verify your trademark registration number and expiry date on the IP India portal (ipindiaonline.gov.in).
Only two documents are needed: Form TM-R (renewal application) and a Power of Attorney (if filing through an agent), as specified in Rule 57. No company documents, address proofs, or trademark specimens are required, unlike a new registration.
E-filing: ₹9,000 per class. Physical filing: ₹10,000 per class. E-filing is cheaper, faster, and more widely recommended.

Late Renewal — Grace Period (0 - 6 Months)
If you miss the one-year window, you still have a chance. The law provides a 6-month grace period right after the expiry date. During these six months, you can still file your renewal application, but you will have to pay an extra late fee on top of the regular renewal fee. The late-renewal figure adds a surcharge on top of the base fee — e-filing costs ₹13,500 per class during the grace period.
Trademark Restoration (6–12 Months After Expiry)
Between 6 and 12 months after expiry, your trademark is technically dead but can be revived. This requires a formal restoration application with additional fees and explanations for the delay. E-filing for restoration costs ₹18,000 per class (₹9,000 renewal fee + ₹9,000 restoration fee). The Registrar has discretionary power to accept or reject restoration applications. What Happens If You Don't Renew Your Trademark?
Non-renewal has serious consequences under Section 25(4) of the Trade Marks Act, 1999:
- Your trademark is removed from the Register of Trade Marks.
- You lose all exclusive rights to your brand name, logo, and mark.
- Competitors can legally begin using your brand name.
- Your mark becomes available for others to register — meaning someone else can own your brand identity.
- You lose legal standing to take infringement action against copycats.
The Registrar sends a notice (Form O-3) to the registered proprietor reminding them of the renewal deadline, usually six months before expiry. However, owners must still be proactive and not depend only on this notice.
